Crime of Power Abuse and Crime of Neglect of Duty have both similarities and differences. In accordance with criminal law in force, they have the same subject (functionaries of State Organs), same object (normal management of State Organs), and the same objective aspects (heavy losses on public properties, interests of the State and people).
滥用职权罪与玩忽职守罪既有相同点也有不同点,依据现行刑法的规定,相同点有:在主体上,二者均为国家机关工作人员;在客体方面,二者都侵犯了“国家机关的正常管理活动”这一同类客体;另外,二者都必须有致使公共财产、国家和人民利益遭受重大损失这一后果。
